The Blue Ribbon already means liberty and freedom especially Freedom of Speech/expression, it is now our rallying symbol to bring the fight public.
It's amazing how many people don't think about it when they are talking to their friends or reading a book of their choice,that all of the rights and liberties and we have can be stripped away. The first time you get a ticket or get arrested for cursing on a public street...or are issued a citation for reading the Da Vinci Code or Harry Potter...you will be outraged... by Then it's too late
Morality in Media and and many other fundamentalist catholic/christian groups rallied around an event started in Pennsylvania by Norma Harris 20 years ago in Lancaster Pennsylvania. That event is known as WRAP week which stands for (White Ribbon Against Pornography) which is always the 1st week of November ending just days before the presidential elections every 4 years. All across the country supporters are urged to show their support by writing letters to congress,boycotting stores that sell adult materials,wear the white ribbon and the groups themselves purchase ad space in major newspapers that say "Porn is Illegal..it is NOT Protected by the Constitution"
That is a flawed argument that they have stood behind since the 70's. The idea they use to justify is the fact that "Obscenity" is not protected by the Constitution. The only way something can be considered obscene is if it meets the 3 rules of the Miller Test:
1. Obscene material is not protected by the First Amendment. Roth v. United States, 354 U.S. 476, reaffirmed. A work may be subject to state regulation where that work, taken as a whole, appeals to the prurient interest in sex; portrays, in a patently offensive way, sexual conduct specifically defined by the applicable state law; and, taken as a whole, does not have serious literary, artistic, political, or scientific value. Pp. 23-24.
2. The basic guidelines for the trier of fact must be:
(a) whether "the average person, applying contemporary community standards" would find that the work, taken as a whole, appeals to the prurient interest, [Roth, supra, at 489,]
(b) whether the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law, and
(c) whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value. If a state obscenity law is thus limited, First Amendment values are adequately protected by ultimate independent appellate review of constitutional claims when necessary. [Pp. 24-25.]
3. The test of "utterly without redeeming social value" articulated in Memoirs, supra, is rejected as a constitutional standard. [Pp. 24-25.]
4. The jury may measure the essentially factual issues of prurient appeal and patent offensiveness by the standard that prevails in the forum community, and need not employ a "national standard." [Pp. 30-34.]
As far as the religious right is concerned Porn itself meets those standards and is therefore obscene and not protected. Well thankfully the Supreme Court for the most part has not seen it that way and a majority of the obscenity cases over the past 30 yrs. have been struck down leaving only a few shady rulings...most notably the recent ruling that Jm Productions: Gag Factor 18 was obscene but magically 1-17 were ok. The Jurors spoke after the trial and said that they may not have come to that ruling if the defense were able to show the mountain of other titles available in the stores around the city that feature the same kind of "Extreme BJ"...the shady part...The judge refused to allow them to show the other titles saying the trial was about THIS film not what others are doing.
These cases are scary because they set precedents that can cause an avalanche. 1st it is an Extreme BJ film...then they test the waters and say that now a film depicting a regular BJ is obscene...that passes..hmm ok lets target the sex acts in general that are not "normal"...now Fetish films are obscene. Ok that worked....now non-simulated sex acts of unnatural positions (every single one but missionary) that passes...wow we are on a roll...what about missionary......now Porn is gone the industry is dead both online and off...what next...the Children are obviously not safe yet.
We got real sex off the screen...why not simulated sex...and this ladies and gentlemen leads right down into the heart of Hollywood films...and while they are at it they will target cursing in films etc etc.
Ask smokers how their rights are being destroyed....how about if our speech was treated the same way. The snowball effect is what needs to be stopped...whether you fully support Pornography or not you must at least support its right to exist when all the participants are willing.
That is a chilling image of where our country is headed but sadly its a very realistic one because as it stands now...the Adult Industry is the ONLY industry standing up for your rights. You never see Steven Speilberg or Tom Cruise talk about free speech and the constitution...no its Max Hardcore and Larry Flynt and in the mainstream media its Howard Stern.
They have made great strides but its not enough...the American people NEED to stand up against these religious organizations and say "ENOUGH IS ENOUGH" they are not the only ones who matter. It is the PARENTS job to protect their kids from things they may not want them to see. Not OURS....and certainly should not impede what I want to enjoy..YOUR KID IS NOT MY PROBLEM. They have many different web blockers and V-Chips even dvd players and game systems have parental locks to block your kids from seeing stuff. USE IT....THE TIME IS NOW!
